Abstract
:
Given the tremendous development, the communication industry witnessed the emergence of the international information network, the internet, and the advancement of the international trade movement. It was necessary to provide judicial protection for electronic contracts. Hence, our study came to identify the judicial protection needed before concluding the electronic contract via social media by identifying the parties to the electronic contract, preemptive protection for the electronic consumer, and identify the penal protection of the consumer as well as the types of penal consumer protection, in addition, to identifying the types of electronic crimes and forms of consumer criminal protection. The study concluded several findings, mainly the Saudi legislator dedicates special interest to electronic trade in terms of regulation and protection. Among the features of the Saudi legislators’ interest in the electronic trade, they drafted laws and legal provisions that provide necessary protection to the electronic consumer, such as electronic transactions law, The Anti-Commercial and Industrial Fraud Law, and the Anti-Cybercrime Law, as well as the Saudi Regulator, set up bodies that protect the electronic consumer, such as the Consumer Protection Association and the Ministry of Commerce and Industry. The study recommended providing adequate judicial protection to the consumers as they are the weak party in the contractual relationship and that consumer protection measures go beyond the borders of the state utilizing international cooperation to achieve the targeted protection by exchanging information related to consumer protection and boosting the connections related to products banned, withdrawn from the market or has been restricted, as well as reinforcing electronic monitoring and reinforce the role of oversight committees, and setting up platforms to monitor websites and electronic applications.
